Defamation Sexual Assault Case Withdrawn and Expunged

Attorney Fienman got a wrongly accused sexual assault case for a Philadelphia resident withdrawn and subsequently expunged from his record.

Fienman’s client was accused of sexually assaulting a young woman at a popular bar in Philadelphia on New Year’s Eve. Charges were filed after a months-long investigation.

Having retained Attorney Fienman promptly after the alleged incident, the client benefited from immediate legal support when he was detained by PPD and arraigned in Court. Fienman intervened and personally appeared before the magistrate in the middle of the night. Because of Fienman’s advocacy, bail was initially set relatively low. This, in turn, resulted in an  immediate appeal by the acting Assistant District Attorney which prevented his client’s release. Because Mr. Fienman was physically present in the courthouse at 2:00 a.m., he was able to avoid an appeal hearing and secure his client’s release by successfully negotiating an agreement with the supervisor from the District Attorney’s Office.

Thereafter, at the preliminary hearing, the case was ultimately withdrawn because the complainant could not positively identify the accused as the perpetrator of the sexual assault. Subsequently, Attorney Fienman facilitated the expungement of the case from the client’s record.  

The outcome of an individual case depends on a variety of factors unique to that case. Case results do not guarantee or predict a similar result in any similar or future case.
